Airbnb v Doe : The Florida Supreme Court Takes on Arbitrability in Florida

The Florida Supreme Court has accepted the case Airbnb, Inc. v. Doe to decide the question of whether the incorporation of arbitration rules which provide that the arbitrator will decide questions of his or her own jurisdiction is sufficient to divest the courts of this power. Although most courts that have addressed this issue have concluded that the incorporation of such rules is sufficient, the issue has become the subject of considerable national debate. The Miami International Arbitration Society recently submitted an amicus brief [link below] on this issue before the Florida Supreme Court. This CLE program will include a mock oral argument of this potentially pivotal case, in which members of the team who acted as counsel for MIAS in the amicus brief will argue for each side and field questions from what is expected to be a “hot bench.” The moot will be followed by a discussion among the participants. Growth and Opportunity in Latin American ADR: The Arbitral Process and Beyond In the latest installment of the International Law Section of the American Bar Association's “What the Rules Do Not Tell You” Series, we will take a practical approach to understanding growth and opportunity in the Latin American ADR scene. Panel I: Opportunity in the Arbitral Process International mediator and arbitrator Mercedes Tarrazon shares her views on the opportunities during the arbitral process based on her experience in high-profile international disputes. May 13, 2021 The ICC recently issued the report of its worldwide task force on the effect of human memory on witness evidence. This report, several years in the making, addresses human memory is it affects international arbitration. Task force commissioned psychological research into how practices followed in international arbitration can affect memory and therefore witness testimony. The task force presented a series of recommendations for multiple actors involved in the arbitral process, including arbitrators, in-house counsel, and outside counsel. Jose Astigarraga, Global Chair, International Arbitration, Reed Smith and Co-Chair of the ICC Task Force, will present an overview of the task force’s findings and recommendations as well as some insights revealed by the input received from the task force’s members from across the globe.People & Blogs
